Those involved in motor vehicle accidents may also have a tort claim. A tort claim involves bringing a legal action against the at-fault party or at-fault parties. In a tort claim, unlike an accident benefits claim, you may obtain compensation for pain and suffering. In general, a tort claim must be commenced by the second anniversary after which you discover or ought to have discovered that you have sustained serious impairment as a result of the motor vehicle accident.

ACCIDENT BENEFITS
CLAIMS

Accident benefits are available to anyone involved in a motor vehicle accident under what is known as the Statutory Accident Benefits Schedule (SABS). These benefits are known as no-fault benefits.
Romano Law Firm understands the crucial demands and timelines that have to be met in order protect your entitlement to accident benefits:

  • You must notify your insurance company immediately of the accident (If you do not have an insurance company, notify the insurance company of the other vehicle(s) involved in the accident).
  • You must complete the application forms (including a form substantiating your income loss which must be completed by your employer and a form substantiating your injuries which must be completed by a treating physician).
  • If you are self-employed, you must be able to substantiate your income and may require the assistance of an accountant.
  • You may have to provide a sworn statement to a representative of the insurance company about the circumstances of the accident and the injuries arising from it.

The following Accident Benefits may be available:

  • Income replacement benefits in the amount of 70% of your gross income/week, up to a maximum of $400/week. This benefit is payable for two years after the accident so long as you are substantially unable to perform the essential tasks of your employment. The income replacement benefit will only continue after two years if you have a complete inability to engage in any employment for which you are reasonably suited by education, training or experience.
  • If you were unemployed at the time of the accident, you are not entitled to any weekly benefit in lieu of income for at least six months. However, if you suffer a complete inability to carry on a normal life after six months, you will become entitled to a non-earner benefit in the amount of $185/week.
  • Medical and rehabilitation and attendant care expenses are generally limited to $100,000.00.
  • A death benefit is automatically payable to the deceased’s spouse and dependents. A spouse receives $25,000.00 and Dependents receive $10,000.00.
  • Funeral expenses are paid to a maximum of $6,000.00
